Pour rappel, les \u00e9pisodes \u00e0 venir sont le passage du texte devant la commission mixte paritaire et le S\u00e9nat. <\/b><\/p>\n<p>Les dispositions relatives \u00e0 la <a href=\"https:\/\/awsolutions.fr\/blog\/1-sourcing-fournisseurs-marches-publics\/\">commande publique<\/a> font couler beaucoup d\u2019encre et les r\u00e9actions sont nombreuses.<\/p>\n<p>Bercy s\u2019est donc exprim\u00e9 sur ces diff\u00e9rentes mesures pour en pr\u00e9ciser les impacts. Mais l\u2019attente des acheteurs publics portait surtout sur la disposition relative au motif d\u2019int\u00e9r\u00eat g\u00e9n\u00e9ral comme hypoth\u00e8se de dispense de proc\u00e9dure.<\/p>\n<p>Est-ce \u00ab la porte ouverte \u00e0 toutes les fen\u00eatres \u00bb ?<\/p>\n<p>Le motif d\u2019int\u00e9r\u00eat g\u00e9n\u00e9ral pouvant \u00eatre interpr\u00e9t\u00e9 diff\u00e9remment selon certains acheteurs.<i> \u00ab Des march\u00e9s \u00e0 plusieurs millions pass\u00e9s sans mise en concurrence \u00bb, \u00ab fin de la transparence \u00bb<\/i> ?<\/p>\n<p>La Direction des affaires juridiques pr\u00e9cise la chose suivante : <i>\u00ab Il ne s\u2019agit pas [\u2026] de permettre aux acheteurs <b>de d\u00e9cider eux-m\u00eames de d\u00e9roger aux proc\u00e9dures<\/b> en fonction de leur propre appr\u00e9ciation de l\u2019int\u00e9r\u00eat g\u00e9n\u00e9ral \u00e0 un moment donn\u00e9. Les cas d\u00e9rogatoires restent d\u00e9finis par d\u00e9cret en Conseil d\u2019\u00c9tat (art. R. 2122-1 et s. du CCP). \u00bb<\/i><\/p>\n<ul>\n<li style=\"text-align: justify;\">En somme, les motifs d\u2019int\u00e9r\u00eat g\u00e9n\u00e9ral seront limitativement \u00e9num\u00e9r\u00e9s dans un texte de valeur r\u00e9glementaire.<\/li>\n<\/ul>\n<div>\n<p>Les autres mesures sont plus \u00e9videntes \u00e0 cerner.<\/p>\n<\/div>\n<ul>\n<li style=\"text-align: justify;\">Le seuil de dispense de proc\u00e9dure est relev\u00e9 \u00e0 100 000 \u20acHT en travaux pour faciliter la relance par les chantiers publics (mesure limit\u00e9e dans le temps, jusqu\u2019au 31\/12\/2022).<\/li>\n<li style=\"text-align: justify;\">Le code de la commande publique sera compl\u00e9t\u00e9 par un dispositif relatif aux circonstances exceptionnelles pour faire face aux difficult\u00e9s li\u00e9es \u00e0 une crise majeure (\u00e9tat de guerre, pand\u00e9mie, crise \u00e9conomique majeure, catastrophe naturelle). Ces dispositions permettront entre autre de proroger de fa\u00e7on proportionn\u00e9e le d\u00e9lai d\u2019ex\u00e9cution des march\u00e9s. Les <a href=\"https:\/\/awsolutions.fr\/blog\/13-entreprises-vous-avez-droit-au-benefice-de-lavance\/\">entreprises<\/a> ne pourront par ailleurs \u00eatre sanctionn\u00e9es en cas de difficult\u00e9 d&rsquo;ex\u00e9cution li\u00e9es \u00e0 la crise.<\/li>\n<li style=\"text-align: justify;\">L\u2019exclusion des march\u00e9s de services juridiques du champ de la commande publique.<\/li>\n<li style=\"text-align: justify;\">Extension des march\u00e9s potentiellement r\u00e9serv\u00e9s aux PME pour p\u00e9renniser ce qui a \u00e9t\u00e9 d\u00e9j\u00e0 mis en place.<\/li>\n<\/ul>\n<p style=\"color: #479e9a; font-size: 18px; line-height: 21px; font-family: 'Fira Sans'; font-weight: 500;\" data-fusion-font=\"true\" data-fusion-google-font=\"Fira Sans\"
